Terms & Conditions

For ease of international understanding, the services and agreements are presented in English. However, they remain legally binding under German law. Eine deutsche Version der AGB findet sich hier.

1. Scope & Applicability

These Terms & Conditions apply to all concepts, design commissions, deliveries, consulting services, educational programs, and other services provided by Silvia Geßner, Whakami.de (hereinafter referred to as “Whakami”) to her clients.

Any differing Terms & Conditions only apply if agreed in writing prior to confirmation of the assignment.

To support readability, gendered language has been minimized. Where gendered terms appear, they are intended to include all gender identities equally.

2. Client Eligibility

Whakami works exclusively with business clients (entrepreneurs, freelancers, or companies). By entering into a contract, clients confirm that the services, content, and/or materials are being used within the scope of their commercial or professional activity and not for private purposes as defined by §13 BGB (German Civil Code).

3. Fees & Payment

  1. All fees are quoted as net amounts and subject to the applicable VAT rate under German tax law.

  2. Invoices are issued at the end of the project, including applicable travel expenses, or immediately upon booking for digital and in-person classes.

  3. Unless otherwise agreed, payment is due within 14 calendar days of the invoice date, without deductions. Or immediately upon booking for digital and in-person classes.

4. Liability

  1. Whakami is liable for material or legal defects in accordance with applicable legal provisions.

  2. Claims for damages beyond defect-related liability can only be made in cases of intent or gross negligence.

  3. Liability under the German Product Liability Act or other mandatory statutory provisions remains unaffected.

5. Data Protection

  1. Clients consent to the processing and storage of personal data required for order fulfillment, including on secure third-party cloud services as needed. Data is handled in compliance with the General Data Protection Regulation (GDPR) and German privacy laws (BDSG, TMG).

  2. Client data may be used to inform about new offerings, relevant services, or useful topics.

  3. Clients may withdraw consent at any time with future effect. Upon revocation, personal data will be deleted promptly, subject to any legal retention obligations.

6. Governing Law & Jurisdiction

All contracts are subject to the laws of the Federal Republic of Germany. The place of jurisdiction is Hamburg, unless otherwise required by mandatory legal provisions.
